Terms of Service

Read the Terms of Service for Galas LGBTQ+ Armenian Society, including our code of conduct, privacy practices, event participation policies, and media consent. Learn how we protect our community and your rights.

Introduction and Overview

Welcome! You have arrived at a website and/or are interacting with our Service (defined below), which is owned and operated by the Galas LGBTQ+ Armenian Society (“Galas,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of any online service location (e.g., website or mobile app) that posts a link to these Terms (“Site” or “App”) (including both mobile and online versions). It also applies to your use of all features, widgets, plug-ins, applications, content, downloads, and/or other services (i) we own and control and make available through a Site, and/or (ii) that post or link to these Terms (collectively, the “Service”), regardless of how you access or use it, whether via computer, mobile device, or otherwise. By using the Service, you acknowledge and accept the Service’s Privacy Policy and consent to the collection and use of your data in accordance with the Privacy Policy. By using the Service, you further agree that Galas may change, alter, or modify the settings or configurations on your Device (defined below) in order to allow for or optimize your use of the Service. By interacting with and/or using the Service, you signify your assent and agreement to these Terms. If you do not agree to these Terms, you must not use the Service.

You should read these entire Terms; but here is a partial list of some of the terms that we want to bring to your initial attention (scroll down for details, which terms and not the headings or summaries govern) in the event you are on a smart phone or other device with a small screen. Capitalized terms have the meanings given to them where defined in these Terms.

Each time you use the Service, the Terms, and any applicable Additional Terms (defined below), then posted apply (subject to Section 15), so you should check back each time you return for any updates.

You may only use the Content (defined below) on the Service in connection with your permitted activities on the Service and not in an offline environment or in connection with another site or service. (Section 1 and Section 3) You grant us a broad license to content you submit or post. (Section 2)

Except as set forth in the Privacy Policy that applies to the Service and our Notice of Privacy Practices for Protected Health Information, you and we do not have a confidential, fiduciary, or any other special relationship by virtue of your use of the Service or your communications to us through or related to the Service. (Section 2)

You consent to our Privacy Policy and of Privacy Practices for Protected Health Information, and our practices detailed in them.

As permitted by law, many types of disputes that may arise in connection with your access to and use of the Service are subject to mandatory arbitration – which includes your waiver of a right to a jury trial and to class action relief. (Section 11)

We are providing the Service to you on an “as-is” basis, without any warranty of any kind, and our liability to you in connection with your use of the Service is very limited. Many other limitations and disclaimers relate to your use of the Service. (Section 12, Section 13 and Section 14)

Using the Service

If you want to use this Service, then carefully read these entire Terms (including all links to details), as they constitute a written agreement between you and us and they affect your legal rights and obligations. The summaries of provisions and section headings are provided for convenience only and shall not limit the full Terms.

Each time you access and/or use the Service (other than to simply read these Terms), you agree to be bound by and comply with these Terms and any applicable Additional Terms then posted (subject to Section 15). Therefore, do not use the Service if you do not agree. The business realities associated with operating the Service are such that, without the conditions that are set forth in these Terms – such as your grants and waivers of rights, the limitations on our liability, your indemnity of us, and our arbitration of certain disputes – we would not make the Service available to you.

In some instances, both these Terms and separate guidelines, rules, or terms of service or sale setting forth additional or different terms and/or conditions will apply to your use of the Service or to a service or product offered via the Service (in each such instance, and collectively “Additional Terms”). To the extent there is a conflict between these Terms and any Additional Terms, the Additional Terms will control unless the Additional Terms expressly state otherwise. Please also review the terms of the Service’s Privacy Policy, which you accept by using the Service.

Linkable Terms

These Terms are posted to ease your review, especially using smart phones and other devices with small screens. It is important that you read and understand these entire Terms before using the Service. To ease review, each section below includes a brief introductory summary and a link to the full explanation. Please note that the complete provisions, and not the headings or summaries shall govern. See below for the full explanation.

  1. Service Content, Ownership, Limited License, and Rights of Others. We only grant you a limited revocable license to use the Service for your own non-commercial use subject to rules and limitations.

  2. Content You Submit and Community Usage Rules. You grant us a broad license, which we may sublicense, to the content you submit, which you represent you have the right to allow us to use. You, however, retain ownership of and responsibility for, your content. Use of our Service is subject to community usage rules and we have the right to manage our Service to keep its content appropriate. California minors have certain content removal rights.

  3. Service and Content Use Restrictions. Your use of our Service is subject to various restrictions designed to protect the Service and our users. We may change or discontinue our Service in whole or in part.

  4. Accounts. You may have the opportunity to open, revise and close your accounts, subject to certain rules. We may offer you the ability to make choices regarding how and to whom some aspects of your account are used and seen, but these may not be completely effective.

  5. Procedure For Alleging Copyright Infringement. Users may not post content they do not own or control, and may be suspended or terminated if they do so. Copyright owners may give us notice of infringement as detailed in this section, and we will respond in accordance with applicable law.

  6. Procedure For Alleging Infringement of Other Intellectual Property. You can also give notice of trademark and other infringements that you think occur on the Service.

  7. Notices, Questions and Customer Service. Click here to contact us for customer service or questions. You agree we may provide you notices, including notices of new terms and conditions, by posting notice on the home page or by other reasonable means, such as to the e-mail you provided.

  8. Links By You to the Service. You may link to our Service, subject to some basic requirements.

  9. Third-Party Sites; Advertisements; Dealings With Third Parties. We are not responsible for third parties or their content, advertisement(s), apps or sites. For instance, our web sites and mobiles apps may be integrated into third-party sites and apps that we do not control. Similarly, we may make third-party content or services available to you on or via our Service, which we also do not control. This may include the ability to register or sign in to our Services using Facebook Connect or other third party tools, and to post content on third party sites and services using their plug-ins made available on our Services. Use caution when dealing with third parties.

  10. Wireless, Messages, and Location-Based Features. Wireless carrier charges may apply to use of the Service via wireless networks or Devices for which you will be responsible. You may be given opportunities to subscribe to various text marketing or other text messaging programs and by doing so, you consent to receive ongoing text alerts (including by auto-dialers). You may cancel or modify our e-mail marketing communications you receive from us by following the instructions contained within our promotional e-mails.

  11. Dispute Resolution. To the extent permitted by applicable laws, you agree to arbitrate most disputes and waive jury trial and class actions.

  12. Disclaimer of Representations and Warranties. We disclaim most warranties and provide the Service “As Is.”

  13. Limitations of Our Liability. Our liability is greatly limited as more fully explained in this section.

  14. Waiver of Injunctive or Other Equitable Relief. You waive equitable or injunctive relief.

  15. Updates to Terms. These Terms and applicable Additional Terms posted on the Service at each time of use apply to that use, and the Terms may be prospectively updated as our Service evolves. Posting of new Terms on the Service is notice to you thereof.

  16. General Provisions. You agree to various other terms and conditions, which you should read here, including regarding (a) our control and discretion; (b) the law that governs these Terms; (c) your indemnity of us; (d) accessing the Service from outside of the United States; (e) restriction on the Service for those countries subject to U.S. export controls; (f) enforcement and interpretation of these Terms; (g) communications with us; (h) investigations, cooperation with law enforcement, termination and survival; (i) limit on assignment and delegation of rights and obligations; (j) how waivers may be made; (k) your responsibility for your connectivity and access; and (l) CA consumer rights and notices.

  17. Terms Applicable For Third Party Platforms. There are some other things you should know if you are accessing or using the Service through a third party platform.

1. Service Content, Ownership, Limited License, and Rights of Others

  • Content. The Service includes a variety of: (i) materials and other items relating to Galas LGBTQ+ Armenian Society and its initiatives, events, and services, as well as similar items from our partners and other third parties, including all layout, information, articles, posts, text, data, files, images, scripts, designs, graphics, button icons, instructions, illustrations, photographs, audio clips, music, sounds, pictures, videos, advertising copy, URLs, technology, software, interactive features, the “look and feel” of the Service, and the compilation, assembly, and arrangement of the materials of the Service and any and all copyrightable material (including source and object code); (ii) trademarks, logos, trade names, trade dress, service marks, and trade identities of various parties, including those of Galas LGBTQ+ Armenian Society (collectively, “Trademarks”); and (iii) other forms of intellectual property (all of the foregoing, collectively “Content”).

  • Ownership. The Service (including past, present, and future versions) and the Content are owned or controlled by Galas LGBTQ+ Armenian Society, our licensors, and certain other third parties. All rights, title, and interest in and to the Content available via the Service are the property of Galas LGBTQ+ Armenian Society, our licensors, or certain other third parties, and are protected by U.S. and international copyright, trademark, trade dress, patent, and/or other intellectual property and unfair competition rights and laws to the fullest extent possible. Galas LGBTQ+ Armenian Society owns the copyright in the selection, compilation, assembly, arrangement, and enhancement of the Content on the Service.

  • Limited License. Subject to your strict compliance with these Terms and any Additional Terms, Galas LGBTQ+ Armenian Society grants you a limited, non-exclusive, revocable, non-assignable, personal, and non-transferable license to download (temporary storage only), display, view, use, play, and/or print one copy of the Content (excluding source and object code in raw form or otherwise, except as made available to enable display and functionality) on a personal computer, mobile phone, or other Internet-enabled device (each, a “Device”) and/or print one copy of the Content for your personal, non-commercial use only. This limited license (i) does not grant you any ownership of, or other intellectual property interest in, any Content, and (ii) may be suspended or terminated at any time, at Galas LGBTQ+ Armenian Society’s sole discretion, without prior notice or liability. In certain cases, we may grant you additional access to and use of Content, subject to specific Additional Terms.

  • Rights of Others. In using the Service, you must respect the intellectual property and other rights of Galas LGBTQ+ Armenian Society and others. Unauthorized use of Content may violate copyright, trademark, privacy, publicity, communications, and other laws, and such use may result in personal liability, including potential criminal liability. Galas LGBTQ+ Armenian Society respects the intellectual property rights of others. If you believe that your work has been infringed through improper posting or distribution via the Service, please refer to Section 5 and Section 6 below.

  • Reservation of All Rights Not Granted As To Content and Service. These Terms and any applicable Additional Terms include only limited grants of rights to Galas LGBTQ+ Armenian Society Content and to use and access the Service. No right or license may be assumed under any legal theory, whether by implication, estoppel, industry custom, or otherwise. All rights not expressly granted to you are reserved by Galas LGBTQ+ Armenian Society, its licensors, and other third parties. Any unauthorized use of Galas LGBTQ+ Armenian Society Content or the Service for any purpose is strictly prohibited.

  • Code of Conduct and Participation. Galas LGBTQ+ Armenian Society is committed to providing a safe, inclusive, and respectful environment for all participants in our events and programs. Harassment, discrimination, or any form of inappropriate behavior will not be tolerated. We reserve the right to take appropriate action, including revoking access to our events and programs, against any individual who engages in such conduct.

2. Content You Submit and Community Usage Rules

User-Generated Content.

  1. General. Galas LGBTQ+ Armenian Society may now or in the future offer users of the Service the ability to create, share, post, upload, display, publish, distribute, transmit, or otherwise submit (collectively, “submit”) content such as messages, avatars, text, illustrations, images, graphics, photos, comments, responses, sounds, music, videos, information, ratings, reviews, data, questions, suggestions, personal information, or other materials and ideas contained within them (collectively, “User-Generated Content”). Galas LGBTQ+ Armenian Society may provide these opportunities through forums, blogs, message boards, social networks, content creation tools, social communities, email, or other communication features. Subject to the rights and licenses granted under these Terms, you retain any legally recognized rights, titles, and interests you hold in your User-Generated Content, and you remain fully responsible for it.

  2. Non-Confidentiality of Your User-Generated Content. Except as outlined in Galas LGBTQ+ Armenian Society’s posted Privacy Policy or any Additional Terms, you agree that (a) your User-Generated Content will be treated as non-confidential and non-proprietary by Galas LGBTQ+ Armenian Society – regardless of whether you label it “confidential,” “proprietary,” or similar – and will not be returned, and (b) to the fullest extent allowed by applicable law, Galas LGBTQ+ Armenian Society does not assume any obligation to you or any third party regarding your User-Generated Content. Upon request, you agree to provide any documentation necessary to verify your rights to such content and your compliance with these Terms or any applicable Additional Terms. You acknowledge that the Internet and mobile communications may be subject to security breaches, and submissions of User-Generated Content may not be secure. You accept these risks and will consider them before submitting any User-Generated Content. In your communications with Galas LGBTQ+ Armenian Society, please note that we do not accept any unsolicited ideas or materials for products, services, or suggestions for improvements, including but not limited to ideas, concepts, inventions, or designs for music, websites, apps, books, scripts, screenplays, films, TV shows, theatrical productions, software, or other creative works (collectively referred to as “Unsolicited Ideas and Materials”). Any Unsolicited Ideas and Materials you send to us or post via our services will be considered User-Generated Content and licensed to us as outlined below. Additionally, Galas LGBTQ+ Armenian Society retains the same rights as the general public regarding your Unsolicited Ideas and Materials. Receiving your Unsolicited Ideas and Materials does not imply acknowledgment of their novelty, originality, or priority by Galas LGBTQ+ Armenian Society and does not limit our right to challenge existing or future intellectual property claims related to them.

  3. License to Galas LGBTQ+ Armenian Society. Unless otherwise described in any applicable Additional Terms (such as contest rules), you hereby grant Galas LGBTQ+ Armenian Society a non-exclusive, worldwide, irrevocable, perpetual, royalty-free license to use your User-Generated Content. This includes the right to copy, modify, distribute, display, publicly perform, publish, broadcast, and create derivative works from your content for any purpose, in any format or medium, now known or later developed. This license allows Galas LGBTQ+ Armenian Society to host, store, edit, reformat, and combine your content with other materials, as well as to use any ideas or concepts within it for the development or promotion of products and services. You also agree to grant the organization the right to use your name, likeness, and persona in connection with your content without any compensation to you. By submitting content, you waive any moral rights you may have and consent to modifications or alterations, even if they are not agreeable to you. To the extent these rights cannot be waived, you agree not to exercise them in a way that interferes with the rights granted here. You acknowledge that you will not receive any payment or compensation for granting these rights.

  4. Galas LGBTQ+ Armenian Society’s Exclusive Right to Manage Our Platform. Galas LGBTQ+ Armenian Society may, but is not obligated to, review, monitor, display, post, store, maintain, accept, or otherwise use any of your User-Generated Content. At our sole discretion, we may reject, delete, move, re-format, remove, or refuse to post any User-Generated Content without notice or liability to you or any third party as part of our effort to manage User-Generated Content appropriately. This includes, but is not limited to, content we consider offensive, obscene, lewd, violent, harassing, abusive, illegal, or otherwise inappropriate, as well as to enforce third-party rights, our Terms, or any applicable Additional Terms, including the content restrictions outlined in the Rules (defined in Section 2B). User-Generated Content submitted by you or others may not be stored on our platform indefinitely, and once submitted, you will not have the right to access, archive, or otherwise use such content on our platform or elsewhere.

  5. Representations and Warranties Related to Your User-Generated Content. Each time you submit any User-Generated Content, you represent and warrant that you are at least the age of majority in the jurisdiction in which you reside and are the parent or legal guardian, or have all proper consents from the parent or legal guardian, of any minor who is depicted in or contributed to any User-Generated Content you submit, and that, as to that User-Generated Content, (a) you are the sole author and owner of the intellectual property and other rights to the User-Generated Content, or you have a lawful right to submit the User-Generated Content and grant Galas LGBTQ+ Armenian Society the rights to it that you are granting by these Terms and any Additional Terms, all without any obligation for Galas LGBTQ+ Armenian Society to obtain consent of any third party and without creating any obligation or liability for Galas LGBTQ+ Armenian Society; (b) the User-Generated Content is accurate; (c) the User-Generated Content does not and, as to Galas LGBTQ+ Armenian Society’s permitted uses and exploitation set forth in these Terms, will not infringe any intellectual property or other right of any third party; and (d) the User-Generated Content will not violate these Terms (including the Rules) or any applicable Additional Terms, or cause injury or harm to any person.

  6. Enforcement. Galas LGBTQ+ Armenian Society has no obligation to monitor or enforce your intellectual property rights to your User-Generated Content. However, you grant us the right to protect and enforce our rights to your User-Generated Content, including by bringing and controlling actions in your name and on your behalf (at Galas LGBTQ+ Armenian Society’s cost and expense). By doing so, you hereby consent and irrevocably appoint Galas LGBTQ+ Armenian Society as your attorney-in-fact, with the power of substitution and delegation, which appointment is coupled with an interest.

Community Usage Rules.

As a user of the Service, these Community Usage Rules (“Rules”) are here to help you understand the conduct that is expected of members of the Service’s online communities (“Communities”).

  1. Nature of Rules. Your participation in the Communities is subject to all of the Terms, including these Rules:
     

    • Your User-Generated Content. All User-Generated Content submitted to Galas LGBTQ+ Armenian Society must either be original to you or you must have the necessary rights and permissions from third parties to comply with these Terms and any applicable Additional Terms. Your content must not include visible logos, phrases, or trademarks belonging to third parties. Do not use content owned by others and claim it as your own, including content sourced from the internet. If others contribute to or have rights in your content, or if they appear in or are referenced in it, you must obtain their permission before submitting it to Galas LGBTQ+ Armenian Society. (For example, if someone took a photo of you and a friend, you must get both your friend’s and the photographer’s permission before submitting the photo.)

    • When it Comes to Photos: Only Submit Pictures, Videos, or Images of You and Your Friends or Family. If you submit photos, embed videos, or include images of real people, ensure they feature only you or people you know personally—and only with their explicit permission to share.

    • Act Respectfully. All activity within Galas LGBTQ+ Armenian Society must reflect the community’s values, as determined by us. Respect others’ opinions and comments to help foster an inclusive and supportive environment. If you believe your content might offend or embarrass someone, it likely does not belong here. Harassment, stalking, insults, personal attacks, gossip, and similar behavior are not allowed. Your content must not threaten, harm, or abuse others and must avoid negative remarks about race, national origin, gender, sexual orientation, or physical abilities. Content that is defamatory, slanderous, indecent, obscene, pornographic, or sexually explicit is strictly prohibited.

    • Do Not Use for Commercial or Political Purposes. Content shared within Galas LGBTQ+ Armenian Society must not advertise or promote products, services, commercial activities, or political campaigns, including politicians, public servants, or laws.

    • Do Not Use to Solicit or Send Unwanted Communications. Do not collect email addresses or other contact details of members for unsolicited communications. Avoid soliciting personal information, passwords, or other identifying details for commercial or unlawful purposes. Additionally, refrain from sharing unsolicited or unauthorized advertising, spam, promotional materials, chain letters, or similar solicitations within the community.

    • Do Not Use for Inappropriate Purposes. Content shared within Galas LGBTQ+ Armenian Society must not promote illegal, infringing, or otherwise inappropriate activities.

    • Be Honest and Do Not Misrepresent Yourself or Your Content. Do not impersonate others or share content that is false, deceptive, fraudulent, or misleading. Ensure that your posts accurately represent your identity and affiliation within the community.

    • Respect Public and Semi-Public Spaces. Galas LGBTQ+ Armenian Society encourages meaningful discussions and sharing within the community. However, remember that this is a public or semi-public space, and content posted may be visible to others. Avoid sharing personally identifiable information (e.g., full name, passwords, phone numbers, addresses, credit card details, medical information, or email addresses) and exercise caution when disclosing sensitive details.

    • Don’t Share Other People’s Personal Information. Your User-Generated Content should not include another person’s address, phone number, email address, social security number, credit card details, medical or financial information, or any other sensitive data that could be used to track, contact, or impersonate them, unless explicitly requested by Galas LGBTQ+ Armenian Society in a specific form or method.

    • Don’t Harm the Service or Others’ Devices. Your User-Generated Content must not include viruses, malware, spyware, or any malicious code that could disrupt the functionality of the Galas LGBTQ+ Armenian Society platform or anyone’s devices.

    • If you submit User-Generated Content that Galas LGBTQ+ Armenian Society reasonably believes violates these rules, we may take any legally allowed action at our sole discretion. However, we are not obligated to take any action unless required by law. We may request proof of permissions referenced above in an acceptable format. Failure to provide proof may result in the removal of the User-Generated Content in question from our platform.
       

  2. Your Interactions With Other Users; Disputes. You are solely responsible for your interactions with other users of Galas LGBTQ+ Armenian Society, whether online or offline. We are not responsible or liable for the conduct or content of any user. We reserve the right, but are not obligated, to monitor or become involved in disputes between you and other users. Use common sense and good judgment when interacting with others (e.g., when sharing personal or other information) and in all your online activities.

  3. Reporting Violations. If you encounter any content that violates these Terms, you can report it to us by contacting us here. For intellectual property rights concerns, please refer to Sections 5 and 6 below.

  4. California Minors. California residents under the age of eighteen (18) who are registered to use Galas LGBTQ+ Armenian Society and have posted content or information can request its removal by contacting us at the email or address provided in the “Notices, Questions, and Customer Service” section below. The request must confirm that they personally posted the content or information and specify where it is located. We will make reasonable, good-faith efforts to remove the content from prospective public view or anonymize it to prevent identification of the minor. However, we cannot guarantee complete removal, as third parties may have republished the content or archived copies may exist on search engines or platforms outside our control.

  5. Code of Conduct. Galas LGBTQ+ Armenian Society is dedicated to fostering safe, inclusive, and affirming spaces both online and in person. By participating in any Galas event or using our services, you agree to treat others with respect, dignity, and empathy, while honoring the diverse experiences, identities, and perspectives within the LGBTQ+ Armenian community and beyond. Harassment, discrimination, or abusive behavior of any kind, including intimidation, threats, hate speech, slurs, unwanted sexual attention, physical or verbal harassment, or disruptive behavior that undermines the safety or integrity of our spaces, will not be tolerated. We reserve the right to remove or ban any participant, without refund or notice, from any Galas event, program, or platform if these expectations are violated.

  6. Participation Eligibility. Access to Galas events and programs may be limited to registered participants, members of the LGBTQ+ Armenian community, or invited allies depending on the event’s nature. Galas reserves the right to approve, deny, or revoke access at its sole discretion to protect the safety and purpose of our community spaces.

  7. Photography and Media Consent. By attending Galas LGBTQ+ Armenian Society events or participating in our programs, you acknowledge and agree that photographs, videos, and audio recordings may be taken by professional photographers or authorized personnel. These media may be used by Galas for promotional, educational, or other purposes in print and digital formats. Attendance at our events constitutes your consent to be photographed or recorded and to the use of your likeness in such materials, without compensation. If you prefer not to be photographed or recorded, please inform event staff upon arrival.

3. Service and Content Use Restrictions

  • Service Use Restrictions. You agree that you will not: (i) aside from obtaining goods or services offered by Galas LGBTQ+ Armenian Society or its affiliates, use the Service for any political or commercial purpose (including, without limitation, for purposes of advertising, soliciting funds, collecting product prices, and selling products); (ii) use any meta tags or any other “hidden text” utilizing any Trademarks; (iii) engage in any activities through or in connection with the Service that seek to attempt to or do harm any individuals or entities or are unlawful, offensive, obscene, lewd, lascivious, filthy, violent, threatening, harassing, or abusive, or that violate any right of any third party, or are otherwise objectionable to Galas LGBTQ+ Armenian Society; (iv) to the maximum extent permitted by applicable law, reverse engineer, decompile, disassemble, reverse assemble, or modify any Service source or object code or any software or other products, services, or processes accessible through any portion of the Service; (v) engage in any activity that interferes with a user’s access to the Service or the proper operation of the Service, or otherwise causes harm to the Service, Galas LGBTQ+ Armenian Society, or other users of the Service; (vi) interfere with or circumvent any security feature of the Service or any feature that restricts or enforces limitations on use of or access to the Service, the Content, or the User-Generated Content; (vii) harvest or otherwise collect or store any information (including personally identifiable information about other users of the Service, including e-mail addresses, without the express consent of such users); (viii) attempt to gain unauthorized access to the Service, other computer systems or networks connected to the Service, through password mining or any other means; or (ix) otherwise violate these Terms or any applicable Additional Terms.

  • Content Use Restrictions. You also agree that, in using the Service: (i) you will not monitor, gather, copy, or distribute the Content (except as may be a result of standard search engine activity or use of a standard browser) on the Service by using any robot, rover, “bot”, spider, scraper, crawler, spyware, engine, device, software, extraction tool, or any other automatic device, utility, or manual process of any kind; (ii) you will not frame or utilize framing techniques to enclose any such Content (including any images, text, or page layout); (iii) you will keep intact all Trademark, copyright, and other intellectual property notices contained in such Content; (iv) you will not use such Content in a manner that suggests an unauthorized association with any of Galas LGBTQ+ Armenian Society’s or its licensors’ products, services, or brands; (v) you will not make any modifications to such Content; (vi) you will not copy, modify, reproduce, archive, sell, lease, rent, exchange, create derivative works from, publish by hard copy or electronic means, publicly perform, display, disseminate, distribute, broadcast, retransmit, circulate or transfer to any third party or on any third-party application or website, or otherwise use or exploit such Content in any way for any purpose except as specifically permitted by these Terms or any applicable Additional Terms or with the prior written consent of an officer of Galas LGBTQ+ Armenian Society or, in the case of Content from a licensor, the owner of the Content; and (vii) you will not insert any code or product to manipulate such Content in any way that adversely affects any user experience.

  • Availability of Service and Content. Galas LGBTQ+ Armenian Society may immediately suspend or terminate the availability of the Service and Content (including any elements and features of them), in whole or in part, at its sole discretion and without prior notice or liability. 

  • Reservation of Rights Regarding Content and Service. These Terms and any applicable Additional Terms provide only limited rights to access and use the Content and Service. No additional rights or licenses should be assumed under any legal theory, including by implication, estoppel, or industry custom. All rights not explicitly granted to you are reserved by Galas LGBTQ+ Armenian Society, its licensors, and other third parties. Any unauthorized use of the Content or Service for any purpose is strictly prohibited.

4. Accounts

To access or use certain features of the Galas LGBTQ+ Armenian Society platform, you must first complete the online registration process. The practices related to the collection, use, disclosure, and management of your personal information are outlined in our Privacy Policy. If you are under the age of thirteen (13), you are not permitted to register, use the platform, or submit personal information to us.

If you register for any feature requiring a password or username, you will select your password during registration (or receive an initial randomly generated password via email). By doing so, you agree to the following: 

  1. You will not use a username or email address that is already in use, impersonates another person, belongs to someone else, infringes on intellectual property rights, or is offensive. We reserve the right to reject any username, password, or email address for any reason. 

  2. You will provide accurate, current, and complete information during registration and update it promptly to ensure it remains accurate. 

  3. You are solely responsible for all activities under your account, username, and password, whether authorized by you or not. 

  4. You are responsible for maintaining the confidentiality of your password and restricting access to your device to prevent unauthorized use of your account. 

  5. You will notify us immediately of any unauthorized use of your account, password, or username or any security breach. 

  6. You will not sell, transfer, or assign your account or any rights associated with it.

  7. Galas LGBTQ+ Armenian Society is not liable for any loss or damage resulting from your failure to meet these obligations. If we find or suspect that the information you provided is false, outdated, incomplete, or violates our Terms, applicable laws, or guidelines, we may suspend or terminate your account. Additionally, we reserve the right to terminate or suspend your account, or restrict access to it, at our sole discretion without prior notice or liability.

5. Procedure For Alleging Copyright Infringement

  1. DMCA Notice. Galas LGBTQ+ Armenian Society asks our users to respect the intellectual property rights of others. It is our policy to respond appropriately to clear notices of alleged copyright infringement, as outlined below. At our sole discretion, we may remove content that infringes on another person’s intellectual property rights, with or without notice to the potential infringer. In accordance with the U.S. Digital Millennium Copyright Act (“DMCA”) and other applicable laws, Galas LGBTQ+ Armenian Society has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. If we remove or disable access in response to a DMCA Notice (as defined below), we will make a good faith effort to contact the owner or administrator of the affected site or content so they may make a counter-notification. If you own a copyright in a work (or represent a copyright owner) and believe that your (or the owner’s) copyright has been infringed by improper posting or distribution via our service, you may send us a written notice including the following:
     

    • A subject line that states: “DMCA Copyright Infringement Notice”; 

    • A description of the copyrighted work you claim has been infringed, or if multiple works are covered, a list of such works; 

    • A description of where the allegedly infringing material is located, sufficient to help us identify it (please include the URL of the service where the material appears); 

    • Your full name, address, phone number, and email address; 

    • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, their agent, or the law; 

    • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner; and 

    • Your electronic or physical signature. 

 

It can sometimes be challenging to determine if your copyright has been infringed. Galas LGBTQ+ Armenian Society may choose not to respond to DMCA notices that fail to substantially comply with the outlined requirements. Additionally, Galas LGBTQ+ Armenian Society may remove allegedly infringing material that comes to its attention through notices not fully compliant with the DMCA. Please note that knowingly making a false claim of copyright infringement may expose you to liability under the DMCA. Any information provided in your notice may be shared with the individual responsible for the allegedly infringing material, who may, in turn, submit a DMCA Counter-Notification. In cases of repeat infringement, Galas LGBTQ+ Armenian Society reserves the right to terminate access to its services, as outlined in Section 4 above.

  1. Counter-Notification. If a work you submitted to Galas LGBTQ+ Armenian Society is removed or access to it is disabled due to a DMCA notice, and you believe this action was taken in error or due to misidentification, you may submit a DMCA Counter-Notification. Your Counter-Notification should include the following:
     

    1. A subject line or title stating: “DMCA Counter-Notification.” 

    2. A description of the removed material or disabled access, along with its previous location (please include the URL or specific location where the material appeared). 

    3. A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled due to a mistake or misidentification. 

    4. Your full name, address, phone number, email address, and account username (if applicable). 

    5. A statement consenting to the jurisdiction of the Federal District Court for your address’s judicial district or, if outside the U.S., the United States District Court for the Central District of California, and that you agree to accept service of legal process from the party who submitted the DMCA notice or their agent. 

    6. Your physical or electronic signature.

    7. Knowingly misrepresenting that material was removed or disabled by mistake or misidentification may also expose you to liability under the DMCA.

    8. If Galas LGBTQ+ Armenian Society receives a valid DMCA Counter-Notification, we may reinstate the removed content (or stop disabling access) between 10 and 14 business days after receiving it, unless we are informed that the party who submitted the original DMCA notice has filed a lawsuit seeking a court order to prevent further infringement. Be aware that we may also forward your Counter-Notification to the party who submitted the original DMCA notice.

6. Procedure for Alleging Infringement of Other Intellectual Property 

 

For allegations involving other types of intellectual property, separate procedures may apply.

If you believe your intellectual property (other than copyrights) has been infringed through an improper posting or distribution via the Galas LGBTQ+ Armenian Society platform, you can send us a written notice to the addresses provided. Your notice must include the following:

  1. A subject line stating: “Intellectual Property Infringement Notice”; 

  2. A description of the intellectual property you believe has been infringed; 

  3. Details of where the infringing material is located, including a URL or specific location on our platform; 

  4. Your full name, address, phone number, and email address; 

  5. A statement asserting your good faith belief that the use of the material is unauthorized by the intellectual property owner, its agent, or the law; 

  6. A declaration, under penalty of perjury, that the information in your notice is accurate and that you are the intellectual property owner or authorized to act on their behalf; 

  7. Your physical or electronic signature. 

  8. We will review such notices at our sole discretion. Any user who does not satisfactorily respond to our inquiries about such notices may face suspension or termination. We may share the details of your notice with the individual who uploaded the allegedly infringing material.

Notices, Questions, and Customer Service 

 

You agree that: (1) we may notify you about updates, changes, or important matters by prominently posting on the website homepage or by a reasonable alternative method; and (2) we may contact you by mail or email using the information you provided. By subscribing, you agree to receive ongoing text alerts (including via auto-dialers) regarding our organization, events, and affiliated programs. Standard message, data, and other charges may apply, and your carrier may deduct these from pre-paid amounts or data allowances. If GPS, geo-location, or other location-based features are enabled on your device, you acknowledge that your device location may be tracked and shared in accordance with our Privacy Policy. However, you can stop device location tracking within our mobile application by uninstalling the app. The location-based services provided through Galas LGBTQ+ Armenian Society’s mobile app or features are for personal use only and should not be relied upon in situations where failure or inaccuracy could result in death, personal injury, or property damage. 11. Dispute Resolution 

 

Certain parts of this Section 11 are considered a “written agreement to arbitrate” under the Federal Arbitration Act. You and we agree that this Section 11 meets the “writing” requirement of the Federal Arbitration Act. It may only be amended through mutual agreement.

  1. First – Attempt to Resolve Disputes and Excluded Disputes. If a controversy, allegation, or claim arises out of or relates to the Site, the Content, your User-Generated Content, these Terms, or any Additional Terms (collectively, “Dispute”), or to any of Galas LGBTQ+ Armenian Society’s actual or claimed intellectual property rights (an “Excluded Dispute,” which includes matters outlined in Section 11D), you and we agree to provide written notice to the other party with a reasonable description of the Dispute or Excluded Dispute, along with a proposed resolution. Our notice to you will be sent to the most recent contact information you provided. If no contact information exists or is not current, we are not obligated under this Section 11A. You must send your notice to: Galas LGBTQ+ Armenian Society, 8721 Santa Monica Boulevard, Box #654, West Hollywood, CA 90069-4511, Attn: General Counsel. For sixty (60) days following receipt of notice, Galas LGBTQ+ Armenian Society and you will engage in dialogue to attempt to resolve the Dispute or Excluded Dispute. However, neither party is obligated to agree to any resolution terms they are not comfortable with.

  2. Binding Arbitration. If we cannot resolve a dispute as outlined in Section 11A (or agree to arbitration in writing for an excluded dispute) within 60 days of receiving notice, then ALL DISPUTES BETWEEN YOU AND GALAS LGBTQ+ ARMENIAN SOCIETY (WHETHER BASED ON CONTRACT, STATUTE, REGULATION, TORT – INCLUDING FRAUD OR NEGLIGENCE – COMMON LAW, OR ANY OTHER LEGAL THEORY), WHETHER ARISING BEFORE OR AFTER THESE TERMS TAKE EFFECT, MUST BE RESOLVED THROUGH FINAL AND BINDING ARBITRATION. This includes disputes related to any product, service, or communication connected to GALAS. The Federal Arbitration Act (FAA) will govern the enforceability of all disputes, but California law will apply to claims, remedies, and damages, regardless of its conflict-of-law principles. Disputes will be handled through binding arbitration administered by Judicial Arbitration and Mediation Services Inc. (JAMS) using its Streamlined Arbitration Rules or another arbitration service agreed upon in writing by you and Galas. If an in-person arbitration hearing is necessary, it will take place in Los Angeles, California. Both parties will share arbitration fees as per the applicable rules, but if law requires Galas to cover more or all fees for this section to be enforceable, Galas reserves the right to do so and proceed with arbitration. The arbitrator will apply relevant law, follow these terms, and issue decisions based solely on the presented facts. Decisions will provide relief only to the individual party making the claim. Questions about the scope or enforceability of this arbitration agreement will be decided by a court, not the arbitrator. This arbitration section will remain effective even if these terms or Galas’ services are terminated.

  3. Limited Time to File Claims. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU OR GALAS MUST BEGIN ANY DISPUTE (EXCEPT EXCLUDED DISPUTES) WITHIN ONE (1) YEAR OF WHEN THE DISPUTE ARISES. OTHERWISE, THE CLAIM WILL BE PERMANENTLY BARRED.

  4. Injunctive Relief. The above arbitration rules do not restrict Galas from pursuing legal action for injunctive or equitable relief concerning its site, content, intellectual property, operations, or services.

  5. No Class Action. All disputes will be resolved individually, not as part of any class or group proceeding. YOU AND GALAS AGREE NOT TO BRING CLAIMS AGAINST EACH OTHER IN A CLASS OR REPRESENTATIVE CAPACITY. If a court rules that this class action waiver is unenforceable, the agreement to arbitrate in Section 11B will not apply, and the dispute must proceed in court under Section 11F. Only a court, not an arbitrator, may decide issues regarding the enforceability of this class action waiver.

  6. Federal and State Courts in Los Angeles, CA. Except to the extent that arbitration is required in Section 11B, and except as to the enforcement of any arbitration decision or award, any action or proceeding relating to any Dispute or Excluded Dispute may only be instituted in state or Federal court in Los Angeles, CA. Accordingly, you and we consent to the exclusive personal jurisdiction and venue of such courts for such matters.

  7. Small Claims Matters Are Excluded From Arbitration Requirement. Notwithstanding the foregoing, either of us may bring qualifying claim of Disputes (but not Excluded Disputes) in small claims court, subject to Section 11F.

12. Disclaimer Of Representations And Warranties

 

YOUR ACCESS TO AND USE OF THE SERVICE IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” BASIS. Therefore, to the fullest extent permissible by law, Galas LGBTQ+ Armenian Society and its direct and indirect parents, subsidiaries, affiliates, and each of their respective employees, directors, members, managers, shareholders, agents, vendors, licensors, licensees, contractors, customers, successors, and assigns (collectively, “The Galas Parties”) hereby disclaim and make no representations, warranties, endorsements, or promises, express or implied, as to:
 

  1. the Service (including the Content and the User-Generated Content);

  2. the functions, features, or any other elements on, or made accessible through, the Service;

  3. any products, services, or instructions offered or referenced at or linked through the Service;

  4. security associated with the transmission of your User-Generated Content transmitted to The Center or via the Service;

  5. whether the Service or the servers that make the Service available are free from any harmful components (including viruses, Trojan horses, and other technologies that could adversely impact your Device);

  6. whether the information (including any instructions) on the Service is accurate, complete, correct, adequate, useful, timely, or reliable;

  7. whether any defects to or errors on the Service will be repaired or corrected;

  8. whether your access to the Service will be uninterrupted;

  9. whether the Service will be available at any particular time or location; and

  10. whether your use of the Service is lawful in any particular jurisdiction.

 

EXCEPT FOR ANY SPECIFIC WARRANTIES PROVIDED HEREIN OR IN ADDITIONAL TERMS PROVIDED BY A CENTER PARTY, THE CENTER PARTIES HEREBY FURTHER DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR MISAPPROPRIATION OF INTELLECTUAL PROPERTY RIGHTS OF THIRD PARTIES, TITLE, CUSTOM, TRADE, QUIET ENJOYMENT, SYSTEM INTEGRATION, AND FREEDOM FROM COMPUTER VIRUS.

Some jurisdictions limit or do not allow the disclaimer of implied or other warranties so the above disclaimers may not apply to the extent such jurisdictions’ laws are applicable, and you may have additional rights.

13. Limitations Of Our Liability
 

TO THE EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES WILL ANY CENTER PARTIES BE RESPONSIBLE OR LIABLE FOR ANY LOSS OR DAMAGES OF ANY KIND, including personal injury or death or for any direct, indirect, economic, exemplary, special, punitive, incidental, or consequential losses or damages of any kind, including without limitation loss of profits, that are directly or indirectly related to:

  1. the Service (including the Content and the User-Generated Content);

  2. your use of or inability to use the Service, or the performance of the Service;

  3. any action taken in connection with an investigation by Galas LGBTQ+ Armenian Society or law enforcement authorities regarding your access to or use of the Service;

  4. any action taken in connection with copyright or other intellectual property owners or other rights owners;

  5. any errors or omissions in the Service’s technical operation; or

  6. any damage to any user’s computer, hardware, software, modem, or other equipment or technology, including damage from any security breach or from any virus, bugs, tampering, fraud, error, omission, interruption, defect, delay in operation or transmission, computer line, or network failure or any other technical or other malfunction, including losses or damages in the form of lost profits, loss of goodwill, loss of data, work stoppage, accuracy of results, or equipment failure or malfunction.

The above limitations of liability will apply even if any of the mentioned events or circumstances were foreseeable and even if Galas LGBTQ+ Armenian Society was advised of or should have been aware of the possibility of such losses or damages, regardless of whether you bring an action based on contract, negligence, strict liability, or tort (including whether caused, in whole or in part, by negligence, acts of God, telecommunications failure, or destruction of the Service).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages of the sort that are described above, so the above limitation or exclusion may not apply to you, and you may have additional rights.

Except as may be provided in any applicable additional terms, to the fullest extent permitted by applicable law, in no event will Galas LGBTQ+ Armenian Society's total liability to you, for all possible damages, losses, and causes of action in connection with your access to and use of the service and your rights under these terms, exceed an amount equal to the amount you have paid Galas LGBTQ+ Armenian Society in connection with the transaction(s) that underlie the claim(s); provided, however, this provision will not apply if a court or tribunal with applicable jurisdiction finds such to be unconscionable. For purposes of clarity, the prior sentence does not expand or limit any express, written product warranty that is provided by Galas LGBTQ+ Armenian Society or a manufacturer of a physical product.

14. Waiver of Injunctive or Other Equitable Relief

To the fullest extent permitted by applicable law, if you claim that you have incurred any loss, damages, or injuries in connection with your use of the service, then the losses, damages, and injuries will not be irreparable or sufficient to entitle you to an injunction or to other equitable relief of any kind. This means that, in connection with your claim, you agree that you will not seek, and that you will not be permitted to obtain, any court or other action that may interfere with or prevent the development or exploitation of any website, application, content, user-generated content, product, service, or intellectual property owned, licensed, used, or controlled by Galas LGBTQ+ Armenian Society (including your licensed user-generated content) or a licensor of Galas LGBTQ+ Armenian Society.

The Terms (or Additional Terms, if applicable) posted at the time you use the services of Galas LGBTQ+ Armenian Society will govern your use of those services, including any transactions made during such use. As our organization evolves, the Terms and Conditions under which we offer our services may change, and we may stop providing services under previously applicable Terms or Additional Terms.

Each time you access or use our services, you are agreeing to the most current Terms and Conditions. We may notify you of changes or additional Terms by posting them on the service or through other reasonable means, and your continued use of the service after receiving notice constitutes your agreement to the updated Terms. Please review the posted Terms regularly, especially before engaging in any transactions or submissions.

New or updated Terms will apply to your future use and transactions from the time they are posted, or at a later date if specified. However, the Terms that applied during your previous use will continue to govern those past interactions unless mutually agreed otherwise. Any provision in these Terms or Additional Terms that grants Galas LGBTQ+ Armenian Society a right of consent or approval, or permits Galas LGBTQ+ Armenian Society to exercise a right in its “sole discretion,” may be exercised in its sole and absolute discretion. No consent or approval from Galas LGBTQ+ Armenian Society will be deemed granted without a written agreement signed by an authorized officer of Galas LGBTQ+ Armenian Society. 

  2. Applicable Law. These Terms and any applicable Additional Terms will be governed by and construed in accordance with the laws of the state of California, without regard to conflicts of law provisions that might apply the laws of another jurisdiction. Any disputes or claims will also be resolved according to California law. 

  3. Indemnity. You agree to defend, indemnify, and hold Galas LGBTQ+ Armenian Society and its affiliates harmless from all claims, damages, losses, costs, liabilities, judgments, fines, penalties, settlements, and expenses (including attorneys’ fees) arising from or related to: (i) your submitted content; (ii) your use of the Service; (iii) your breach of these Terms or Additional Terms; (iv) violations of applicable laws or regulations during your use of the Service; (v) materials transmitted through your Device that infringe on third-party rights; (vi) any misrepresentation made by you; and (vii) Galas LGBTQ+ Armenian Society’s use of content you provide (including user-submitted content). You will fully cooperate in defending against any claims. Galas LGBTQ+ Armenian Society reserves the right to assume exclusive defense and control of any claim and may settle or resolve claims at its discretion. You may not settle any claim without prior written consent from an authorized officer of Galas LGBTQ+ Armenian Society. 

  4. Operation of Service; Availability of Products and Services; International Use. Galas LGBTQ+ Armenian Society operates and controls its Service from its offices in the U.S.A. and makes no guarantees that the Service is appropriate or available outside the U.S.A. If you access the Service from other locations, you do so on your own initiative and are responsible for complying with applicable local laws. The Service may describe products or services that are only available within specific regions of the U.S.A. We reserve the right to limit access to the Service or features based on location, entity, or other criteria at our sole discretion. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms or any transactions resulting from your use of the Service.

  5. Export Controls. Software related to or made available by the Service may be subject to U.S. export controls. To the extent permissible under applicable domestic laws, no software from the Service may be downloaded, exported, or re-exported (i) into (or to a national or resident of) any country or jurisdiction to which the U.S. has embargoes (currently including Cuba, North Korea, Iran, Sudan, and Syria), (ii) to anyone on the U.S. Treasury Department’s list of Specially Designated Nationals or the U.S. Commerce Department’s Table of Deny Orders, or (iii) to anyone on the U.S. Department of Commerce’s Bureau of Industry and Security Entities List under the Export Administration Regulations. You are responsible for complying with all applicable trade laws and regulations, both foreign and domestic. You agree not to export or re-export the software to any country, person, entity, or end-user restricted by U.S. export controls as described above.

  6. Severability; Interpretation. If any portion of these Terms or Additional Terms is deemed invalid, unlawful, void, or unenforceable by a court or arbitrator, that portion will be severed, and the remainder of the Terms or Additional Terms will remain in full force and effect. To the extent permitted by law, you agree to waive any statutory or common law allowing a contract to be interpreted against its drafter. The term “including” throughout these Terms will mean “including, without limitation.” Section headings and summaries are provided for convenience only and do not limit the scope of the Terms.

  7. Communications. By communicating with Galas LGBTQ+ Armenian Society electronically, such as via email or text, you consent to receive electronic communications from us. While we aim to respond promptly, we are not obligated to do so. Any agreements, notices, disclosures, or other communications provided electronically satisfy any legal requirements for written communication.

  8. Investigations; Cooperation with Law Enforcement; Termination; Survival. Galas LGBTQ+ Armenian Society reserves the right to (i) investigate suspected breaches of its Service security or systems, (ii) investigate suspected violations of these Terms or Additional Terms, (iii) review data in accordance with its Privacy Policy, including compliance with criminal laws or law enforcement requests, (iv) cooperate with law enforcement in any investigations, (v) prosecute violators of these Terms or Additional Terms, and (vi) suspend, terminate, or restrict access to the Service, including user accounts, at any time without notice or obligation. Suspension or termination does not affect your obligations under these Terms or Additional Terms. Upon termination, your rights to use the Service immediately end, and you must cease use. Provisions that should reasonably survive termination, such as indemnities, releases, disclaimers, and limitations of liability, will remain in effect.

  9. Assignment. Galas LGBTQ+ Armenian Society may assign its rights and obligations under these Terms and any applicable Additional Terms, in whole or in part, to any party at any time without notice. These Terms and any applicable Additional Terms may not be assigned by you, and you may not delegate your duties under them, without the prior written consent of an officer of Galas LGBTQ+ Armenian Society. 

  10. No Waiver. Except as expressly stated in these Terms or any applicable Additional Terms, (i) no failure or delay by you or us in exercising any rights, powers, or remedies will serve as a waiver of that or any other right, power, or remedy, and (ii) no waiver or modification of any term of these Terms or any applicable Additional Terms will be effective unless in writing and signed by the party against whom the waiver or modification is to be enforced. 

  11. Connectivity. You are responsible for obtaining and maintaining all devices, equipment, software, internet service, mobile service, and other services required for your access to and use of the Service. You will bear all related charges. 

  12. California Consumer Rights and Notices. California residents can find information about our privacy practices, including compliance with the California Online Privacy Protection Act and the California Shine the Light Act, in our Privacy Policy.

17. Terms Applicable For Third Party Platforms.

If you are accessing or using the Services via an app available on Apple Inc.’s (“Apple”) App Store for compatible devices (“Apple Platform”), Google Inc.’s (“Google”) Play Store for compatible devices (“Google Platform”), or any other third-party app store for compatible devices (collectively, “Third Party Platforms”), the following terms apply to you and are incorporated into this Agreement:

  1. If you are accessing the Service through a Third Party Platform, you acknowledge that these Terms are entered into between you and Galas LGBTQ+ Armenian Society, and that Apple, Google, or any other third-party platform provider (collectively, “Third Party Platform Providers”) are not parties to this Agreement, except as third-party beneficiaries as described below. 

  2. The license granted to you in Section 1 of these Terms is subject to the Usage Rules set forth in the App Store Terms of Service (see: http://www.apple.com/legal/itunes/us/terms.html) or any applicable third-party terms. 

  3. You acknowledge that Galas LGBTQ+ Armenian Society, not the Third Party Platform Providers, is responsible for providing the Service and its content. 

  4. You acknowledge that Third Party Platform Providers have no obligation to provide any maintenance or support services for the Service. 

  5. To the fullest extent permitted by law, Third Party Platform Providers have no warranty obligations regarding the Service. 

  6. You agree that, as between Galas LGBTQ+ Armenian Society and Third Party Platform Providers, Galas LGBTQ+ Armenian Society is responsible for addressing any claims related to the Service, including but not limited to: (i) product liability claims, (ii) claims of non-compliance with legal or regulatory requirements, and (iii) claims arising under consumer protection or similar laws. 

  7. If the Service, or your use of it, infringes on a third party’s intellectual property rights, you agree that Third Party Platform Providers are not responsible for investigating, defending, or resolving such claims. 

  8. You acknowledge and agree that Third Party Platform Providers and their subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Third Party Platform Providers will have the right to enforce these Terms against you as third-party beneficiaries. 

  9. By using the Service, you agree to comply with any applicable third-party terms related to any platform, technology, or service that interacts with the Service.
